CeltFestABQ™ Hold Harmless Agreement
VENDOR, SOCIETY, CLAN, PARTICIPANT, or VOLUNTEER hereby agrees for itself and its successors and assigns, to indemnify and hold harmless all organizations involved in sponsorship of the Rio Grande Valley Celtic Festival Association, including, but not limited to, those listed below*, as well as the City of Albuquerque, Balloon Fiesta Park, and the owners and managers of any other site used by the above mentioned Festival, from all claims, suits or any other action from personal injuries, including death, Covid 19 and any other infectious diseases, and damages to property, real or personal, caused by vendors, societies, or clans, and/or the sponsoring organizations and/or the City of Albuquerque’s acts or omissions, and arising out of the vendor’s, society’s, or clan’s involvement in the above mentioned Festival, and from all judgments and costs incurred in relation to said claims and suits, and from all expenses incurred in defending said claims and suits.
The vendor, society clan, participant or volunteer shall comply with any applicable health requirements regarding masking, social distancing, and personal hygiene and affirming they will not attend if they have Covid 19, suspect they have Covid 19 or have symptoms of Covid 19.
The vendor, society, clan, participant, or volunteer herein identified hereby releases the sponsoring organizations and the City of Albuquerque, Balloon Fiesta Park, as well as all sponsors and officials, including their agents and employees, from any claim a vendor, society, or clan might otherwise have for participation in the above mentioned Festival, including, but not limited to any claim for personal injury, physical impairment or other claim of any type, arising out of vendor’s, society’s, or clan’s participation or involvement in this event. The vendor, society, clan, participant or volunteer also agrees to indemnify and hold harmless those released above from any such claims, damages, losses, and expenses, including attorney fees.
I understand and acknowledge it is illegal and ill advised to bring alcoholic beverages, or any legal or illegal drugs, onto the City of Albuquerque owned Festival site. Doing so violates the terms of our City lease and, depending on the conduct, also violates state statute. If you are found to be in possession of unauthorized substances, you may be asked to leave or forcibly ejected from the premises. Depending on the conduct, pattern of conduct or attitude of the offending individual you may be banned from re-admittance for the day, the year, or from all future Festival events. Public intoxication may also be dealt with by removal with the same attendant future consequences and agree to comply with the policy regarding such.
